这个只是个故事，法庭是不会采纳辩护人的这个意见的。作为参与轮奸的犯罪嫌疑人，犯罪行为肯定是故意，这没跑，没听说过有“过失强奸”的。其次对于参与轮奸者，法庭会采纳从一般认知上来说，嫌疑人肯定认为女孩是活人，因为作为一般普通人，得知床上躺着的是一具尸体而依然对其性侵的几乎没有。所以法庭一般会以强奸罪来量刑。而且此案性质极其恶劣，后果极其严重，手段极其残忍，必然是以第一人强奸致人死亡量刑，其余参与者按强奸罪从重量刑。
